1. Acceptance of Terms
By accessing or using MedScribe AI ("the Service"), operated at medscribepr.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
MedScribe AI is a clinical documentation copilot that assists licensed healthcare professionals in generating structured clinical note drafts from dictation or typed input. The Service supports multiple clinical note types, bilingual English/Spanish generation, and export to multiple formats including MEDITECH-compatible output.
3. Important Clinical Disclaimers
MedScribe AI is a documentation tool, not a clinical decision-making system. By using this Service, you acknowledge and agree to the following:
Not diagnostic. The Service does not diagnose conditions, recommend treatments, or make clinical decisions. It generates documentation drafts based on your clinical input.
Physician review required. Every note generated by MedScribe AI is a draft. You are solely responsible for reviewing, editing, and approving all generated content before clinical use, signing, or submission to any medical record system.
AI-generated content. Notes are generated using artificial intelligence (GPT-4o). AI-generated content may contain errors, omissions, or inaccuracies. You must verify all clinical details against your own clinical judgment and the patient record.
Professional responsibility. You retain full professional and legal responsibility for any clinical note you sign, submit, or use in patient care, regardless of whether it was generated with the assistance of this Service.
No warranty of clinical accuracy. We do not warrant that generated notes are clinically accurate, complete, or appropriate for any specific patient encounter.
4. Eligibility
The Service is intended for licensed healthcare professionals, medical residents, and authorized clinical staff. By creating an account, you represent that you are a healthcare professional or are authorized to create clinical documentation within your scope of practice.
5. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, ensuring that no unauthorized person accesses your account, and notifying us immediately of any unauthorized access at security@medscribepr.com.
Do not share your account with other individuals. Each user must have their own account for audit trail integrity.
6. Subscription and Billing
6.1 Free Tier
The free tier allows up to 10 notes per day with access to all note types, text export, and bilingual support. No credit card is required.
6.2 Pro Tier ($99/month)
The Pro tier includes up to 50 notes per day, PDF and MEDITECH export, voice-to-note transcription, and priority email support. Billing is handled by Stripe. Your subscription renews monthly unless cancelled.
6.3 Cancellation
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
7. Acceptable Use
You agree not to use the Service for any purpose other than legitimate clinical documentation, attempt to reverse-engineer or extract the AI models or prompts, share generated notes containing PHI through unsecured channels, use the Service to generate fraudulent or misleading clinical documentation, or exceed rate limits or attempt to circumvent usage quotas.
8. Intellectual Property
The MedScribe AI software, interface, prompts, and branding are the property of Dr. Hiram RodrÃguez. You retain ownership of all clinical content you input and all notes generated from your input. We claim no ownership over your clinical data.
9. Limitation of Liability
To the maximum extent permitted by law, MedScribe AI and its operator shall not be liable for any clinical outcomes resulting from use of generated notes, any errors or omissions in AI-generated content, any data loss due to service interruptions, or any indirect, incidental, or consequential damages arising from use of the Service.
Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, use the Service for unauthorized purposes, or fail to pay for a Pro subscription. Upon termination, you may request export of your clinical data within 30 days.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal law. Any disputes shall be resolved in the courts of Puerto Rico.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to registered users via email. Continued use of the Service after changes constitutes acceptance.
